Breaking Abortion Case Update: Texas Values Files Legal Brief to Support Enforcement of Texas Pro-Life Laws
Austin, TX, July 19, 2022 — Texas Values submitted a legal brief to the Texas Supreme Court to support the Texas Attorney General’s effort to enforce pre-Roe pro-life laws. In June, the abortion group Whole Women’s Health filed for a temporary restraining order in federal court in Houston to block the Texas pre-Roe statutes that criminalize abortion and were successful. Attorney General Ken Paxton filed a writ of mandamus to the Texas Supreme Court calling into question the abortion industry’s claims that the Texas pre-Roe statutes have been repealed expressly or by implication, and that the Due Process Clause prevents Texas from enforcing its criminal prohibitions on abortion.
After blocking the Houston judge’s order, the Texas Supreme Court must now decide on the merits of the argument of whether the pre-Roe statutes have been repealed and also how the Human Life Protection Act, also known as the “trigger law,” will affect how abortion is handled legally in the state of Texas.
Texas Values President and attorney Jonathan Saenz released this statement about the action:
“With the recent decision by the Supreme Court, action with respect to abortion has been returned to the states. Texas had a number of laws on the books pre-Roe, and those should be honored. Texas Values supports the culture of life and is pleased to have submitted the amicus brief.”
Texas Values is hoping that the Texas Supreme Court allow the state of Texas to enforce its pre-Roe statutes now that Roe v Wade has been overturned and to continue saving babies’ lives.
